Reality TV star Anna Nicole Smith’s ex-boyfriend’s paternity suit will go forward, now that a judge has denied Smith’s request for a delay in the proceedings. Judge Robert A. Schnider will rule Wednesday on photojournalist Larry Birkhead’s request for a paternity test on Smith’s daughter, 3-month-old Dannielynn Hope Marshall Stern. The hearing will take place at 11:30 a.m. ET in Los Angeles Superior Court, and Birkhead and his attorney Debra Opri will be present. In October, Birkhead filed a second lawsuit against the former Playboy Playmate, this time alleging fraud and conspiracy. He had earlier filed a lawsuit in Los Angeles seeking a court order to demand Smith, who is currently living in the Bahamas, bring the baby to California for a paternity test. In the second lawsuit, Birkhead alleges Smith provided fraudulent information when applying for her daughter’s birth certificate in the Bahamas. Smith identified her current boyfriend and lawyer, Howard K. Stern, as the father. The lawsuit asks that Stern’s name be deleted from the girl’s birth certificate and replaced with Birkhead’s. "I am the father of Dannielynn and I think this is … a crime," Birkhead said in October. "I expect to be reunited with my daughter with the help of my attorneys."

A former boyfriend of Anna Nicole Smith has obtained a court judgment ordering the reality TV star out of her oceanfront residence and he plans to seek her forcible eviction, his lawyer said Thursday. But an attorney for Smith, Wayne Munroe, said he secured a temporary stay of the order and his client has no intention of leaving. Emerick Knowles, the attorney for South Carolina businessman G. Ben Thompson, entered the default judgment on Tuesday after Smith missed a deadline to respond to a suit declaring his client the rightful owner of the gated mansion known as “Horizons.” Munroe appealed to the court, which scheduled a Feb. 19 hearing on whether the default judgment was filed irregularly, he said. The office of the Supreme Court’s registrar could not be reached despite several phone calls seeking confirmation. Smith, who moved to the Bahamas while she was pregnant with her nearly 3-month-old daughter, has remained secluded in the house since her 20-year-old son Daniel died at her hospital bedside on Sept. 10. The 39-year-old former Playboy playmate has claimed that Thompson bought her the nearly $1 million house as a gift. Thompson, who had a brief relationship with Smith, says it was a loan. Knowles said he gained authority to file the judgment with the Supreme Court after a two-week deadline expired Monday, and he asked Smith in writing to vacate by Thursday. Howard K. Stern, an attorney who is Smith’s companion, said the couple did not believe they would be forced to leave anytime soon. “I can assure you that we will continue to stay in Anna Nicole’s house as long as we want to,” he said Thursday in an e-mail to The Associated Press. A private pathologist concluded that Daniel Smith died from a lethal combination of methadone and two antidepressants. Official toxicology results have not been publicly released.

A court in the Bahamas has ordered Anna Nicole Smith to vacate the house she’s living in — STAT. TMZ has obtained a default judgment issued yesterday against Smith (aka Vickie Lynn Marshall). G. Ben Thompson, the owner of the home in which Smith has been living, recently filed papers to evict her. Smith was required to respond to Thompson’s filing by Monday, November 27, but failed to do so. Yesterday, the court entered a default judgment, which means Thompson can now force Smith out of the house. TMZ obtained a letter that Thompson’s lawyer sent to Smith after the default judgment was entered, demanding that she vacate within 48 hours. Thompson was once romantically involved with Smith and claims she told him he was the father of her baby. Thompson says he put a quick end to Smith’s claim when he informed her that he had a vasectomy several years ago.

You’ve heard the rumors that the embattled star and her partner HOWARD K. STERN lost power to their Bahamian home and then were evicted — tonight on ET we go inside their house for the truth. "It’s a big story, someone is trying to evict me," she says. "I own this house and I’m going to let the courts handle it." "We have the documents," Howard adds. "It will come out in court." ET traveled to the enclave last night where the Trim Spa success story set the record straight about reports that she’s been living in the dark. Upon ET’s arrival, the house was lit up and Anna Nicole even showed off her lighted tennis court. "I heard my electricity was off, but it isn’t," Anna Nicole says. "I’m not sure because the electricity was shut off for an hour one day, but I believe it was the town. Down here it goes out — not like in the U.S. I had a generator." While they say the rumors about their power being turned off are false, they do say that someone who is known to them is out to grab headlines. "There is someone who is trying to turn the power off, but again this is with the media, we’re reading that the power is off while it’s on," Howard says. "They want their names in the paper," Anna Nicole adds. "We know who the people are who are trying to shut off the electricity — they want their 15 minutes of fame."

Major announcement on 12/15 about the investigation into Daniel Smith’s death? |

Contrary to published reports, the investigation into the death of Anna Nicole’s son is far from over. Law enforcement sources tell TMZ that the Attorney General of the Bahamas ordered police to re-interview Howard K. Stern regarding the painkiller methadone, and how it ended up in the late Daniel Wayne Smith’s system. Daniel died September 10 in his mother’s hospital room, just days after she gave birth to a baby girl. An autopsy revealed that Daniel had a lethal combination of drugs in his system, including methadone and several antidepressants. Sources in the Bahamas tell TMZ that Royal Bahamas Police interviewed Stern two weeks ago. It’s not the first time Stern has been interviewed. Law enforcement sources say Stern and Anna Nicole were both interviewed several times after Daniel’s death. We’re told that law enforcement officials will make a major announcement about the investigation by December 15.
