Sources tell ET that ANNA NICOLE SMITH is considering burying her late son, DANIEL, in Westwood Village Memorial Park Cemetery beside the crypt of MARILYN MONROE. The reality star has been compared to the iconic beauty and even once lived in a former home of Marilyn’s. Although Anna Nicole is still in the Bahamas and her young son’s body remains in the islands awaiting burial, family members, including his father, BILLY SMITH, attended a memorial service at a local church on Saturday in Mexia, Texas. It was on September 10 that Daniel, while visiting his mom and his baby sister DANNIELYNN in Nassau, tragically died in her hospital room of what turned out to be a lethal combination of prescription drugs. Meanwhile, the paternity battle continues over newborn Dannielynn: both Anna Nicole’s lawyer and committed partner, HOWARD K. STERN, and photojournalist LARRY BIRKHEAD claim to be the little girl’s father. Birkhead has hired celebrity attorney DEBRA OPRI, who filed court papers on his behalf in L.A. Superior Court last Monday to establish paternity and custody of the child. Last Wednesday, Opri made a public plea on behalf of Birkhead for the former Playboy Playmate to bring her daughter to Los Angeles to have a paternity test done. "If you are so certain that Larry Birkhead is not the father, then you have nothing to lose by … allowing a paternity test; it is the proper thing," Opri said after a private hearing in L.A. Superior Court, which is scheduled to continue on October 26th. Although Opri did not discuss details of the closed-door hearing, she added that Anna Nicole should understand Birkhead’s position because she "knows what it is to be a parent" and what it is like to "love and lose a child." Anna Nicole’s attorney, RON RALE, reacted to Opri’s statements, calling some of them inappropriate. He says he wants to protect the privacy of all parties, and in response to Opri’s saying Stern is now stating legally he is the presumed father, Rale says, "I will not discuss what was or was not said in chambers, but I do not believe Ms. Opri should make such comments to the press."

Attorneys for Larry Birkhead, the photographer who filed a paternity lawsuit claiming he’s the father of Anna Nicole Smith’s infant daughter Dannielynn on Monday, pleaded his case to a Los Angeles judge Wednesday morning. The 35-minute hearing was held privately in the chambers of Los Angeles Superior Court Judge Gretchen N. Taylor, and details were not released. However, Birkhead’s laywer Debra Opri said on Tuesday that she would request that Smith and her child return to California for DNA testing, and that the baby tested for drugs. "(Birkhead) wants to find out if (Dannielynn) has drugs in her system," Opri tells PEOPLE in its upcoming issue. "He’s very concerned about the presence of drugs in the home." In a press conference after the hearing on Wednesday Opri would not reveal what happened in court, but said that Judge Taylor had continued the hearing to Oct. 26. Being in the Bahamas protects Smith from having to respond to a suit filed in California, so long as she stays out of the state. Opri, however, did tell reporters, "Anna Nicole Smith knows what it’s like to be a parent, to love a child and to lose that child. Anna Nicole Smith has now taken Larry Birkhead’s baby girl, his daughter." Opri also said that Smith had denied being served legal papers. "She now seeks to challenge that service, as well as the jurisdiction of this state, where both she and Mr. Birkhead conceived their little girl, and where she still maintains a residence," said Opri. "Anna Nicole Smith knows that it is Larry Birkhead, and not Howard Stern, with whom she conceived this child."

It’s hardly a surprise that Anna Nicole Smith’s former friends aren’t happy about her recent "commitment ceremony" to ambitious lawyer Howard K. Stern. Anna’s former manager, Eric Redding, tells Star magazine: "Howard is not the nicest person in the world. He seems very controlling. I think he’s in it for the settlement." Interior decorator Bobby Trendy, Anna’s ex-confidante, claimed: "I don’t know any woman who let that man’s private parts near her – even if they were unattached to his body!" Ouch.

Sources tell ET that LARRY BIRKHEAD — one of the two men claiming to be the father of ANNA NICOLE SMITH’s new baby girl — filed a paternity and custody suit in Los Angeles Superior Court on Monday. Birkhead, Anna Nicole’s former boyfriend, is filing the paperwork so that he can have custody of the three-week-old infant. He also wants to establish paternity. The suit comes in the wake of Anna Nicole’s commitment ceremony with her attorney HOWARD K. STERN last Thursday. Meanwhile, Anna Nicole remains secluded the Bahamas in the wake of her son DANIEL’s death and the media frenzy surrounding the birth of her daughter, DANNIELYNN HOPE.
