Will Anna Nicole Smith have to dig up her son’s body? The former reality show star recently buried her first-born, Daniel, in the Bahamas, where she has established residency — allegedly to avoid a U.S. paternity test on her newborn daughter. Now that it’s been revealed that Smith doesn’t actually own her house in the Bahamas and that her residency there is being challenged, a source tells The Scoop that she’s faced with the possibility that she’s going to have to exhume his body. “She waited as long as she did to bury him [39 days after her son died] because she was trying to figure out if she could get his body into the U.S.,” says a source. “Now that she might get booted out, the word is she’s going to take her son’s body with her.”

An opposition leader in the Bahamas called on the government Wednesday to investigate Anna Nicole Smith’s residence status, saying the reality TV star does not appear to own the Nassau home where she has been living. Hubert Ingraham, leader of the main opposition Free National Movement, said he has learned that another person owns the waterfront mansion that Smith claimed to own in an application for permanent residency. He declined to say whether be believed her status should be revoked. "I expect the government of the Bahamas to make a determination in accordance with the law," he told The Associated Press in a phone interview.

The former reality-show star moved there to avoid the media, she claims, but some are saying that she went to the Bahamas to escape U.S. laws which would force her to submit her baby to paternity tests. Smith has said that her lawyer, Howard K. Stern, is the father of her baby girl, but freelance photographer Larry Birkhead, has said the child is his. And last week, a report appeared claiming that the father of the baby might be a well-to-do man of a certain age named Ben Thompson. It turns out that Thompson paid for the house, according to buzz, and a source tells The Scoop that Thompson’s threatening to evict Smith. “Anna was supposed to pay him back or pay rent,” says the insider. “She got a ton of money selling photos of her with her baby, but so far, she’s not paying rent. Thompson’s totally disgusted by the whole thing. He’s drawing up papers to get her booted out

An attorney for Anna Nicole Smith said Friday the reality TV star has no intention of submitting her 6-week-old daughter for paternity testing as demanded by an ex-boyfriend. A lawsuit filed by photographer Larry Birkhead seeks a court order for Smith to bring the girl to California for a DNA test. A birth certificate lists her companion Howard K. Stern, as the father of Dannielynn Hope Marshall Stern. "Why should she accommodate him at all?" asked attorney Wayne Munroe in an interview with The Associated Press. "I don’t think she’s going to run her life according to his wishes." An attorney for Birkhead, Debra Opri, has said she is traveling to the Bahamas this weekend to take depositions from Smith and Stern on Monday. She could not immediately be reached for comment. Munroe said he has not been notified of a request to meet his client. "It doesn’t sound like they’ve complied with the law," he said.

ANNA NICOLE SMITH will lay her son DANIEL to rest in the Bahamas today, more than a month after his passing. It was on September 10 that Daniel, while visiting his mother and newborn baby sister DANNIELYNN, tragically died in her hospital room of what turned out to be a lethal combination of methadone, Zoloft and Lexapro. ET has learned that a private memorial service with about 25 guests in attendance will be held this afternoon. Daniel will reportedly be buried at the island’s Lake View cemetery wearing a trucker cap, t-shirt and blue jeans — items that are said to be his favorite type of clothing. Sources tell ET that his grieving mother will be wearing a black dress and veil specially made for the occasion by close friend POL ATTEU, the Beverly Hills couture designer who also made her wedding dress in a last-minute request for the commitment ceremony to HOWARD K. STERN.
