A judge Thursday ordered another DNA sample be taken from Anna Nicole Smith's body as he heard more arguments in the fight over the former Playboy Playmate's remains and custody of her infant daughter. Smith's longtime companion, Howard K. Stern, and her estranged mother, Vergie Arthur, each hope to win control of the body. Photographer Larry Birkhead, who claims to have fathered the former centerfold's 5-month-old daughter, Dannielynn, hopes DNA taken from Smith will prove his case and that there was no baby switch. The judge has said the dispute could be lengthy. The hearing, which began Wednesday, stretched into the afternoon Thursday and was to continue Friday. "We're going to have hearings — as many hearings as we need," Circuit Judge Larry Seidlin said Wednesday. "This is just a warm-up." Stern claims he is executor of Smith's will and wants to have her buried next to her son in the Bahamas; Arthur wants her daughter buried in her home state of Texas; and Birkhead simply wants to prove he is the father of Dannielynn, who potentially could inherit millions. Debra Opri, an attorney for Birkhead, said in a statement that she was satisfied DNA samples would be provided by Florida authorities. Opri has said Smith's DNA is needed to connect her with Dannielynn so no one could switch the babies.

Anna Nicole Smith has been peddling exclusive pics of her baby daughter to the tabs, says a source, and has used the cash to buy a house in the Bahamas. “After she sold footage and photos of the birth to a TV show, she starting seeing that child as a cash cow,” says the insider. “Howard K. Stern [Smith’s lawyer and the man whom she claims is the father of the baby] takes the pictures and they sell them to the highest bidder.” The house in the Bahamas could help Smith maintain residency there, since she’s reportedly being booted from her current house in the island nation, where she’s been living — some say to avoid paternity testing. The situation has Larry Birkhead — the photographer who says that he, not Stern, is the baby’s father — “outraged” and “disgusted.” “I’m outraged that they’re trying to pimp my daughter,” Birkhead tells The Scoop. “If Anna wants to sell pictures of herself, that’s one thing, but to conveniently put my daughter in every single photo to up the ante is sick and disgusting. And what’s even more disgusting is that someone would buy them because they are financially assisting someone who’s stockpiling money in an attempt to keep my child from me.”

FORMER Playboy model Anna-Nicole Smith must have a paternity test by the end of this month to determine who her child’s father is, a court has ordered. Los Angeles Superior Court Judge Robert Schnider ruled that Smith and her baby, Dannielynn Hope Marshall Stern, must take the tests by January 23, a lawyer representing celebrity photographer Larry Birkhead said. Birkhead, who claims to be the baby’s father, launched a lawsuit against Smith in October, a month after the child was born. Smith’s long-time personal lawyer, Howard K. Stern, maintains he is the baby’s father. Birkhead’s lawyer Debra Opri said today it was yet to be decided how the tests would be carried out as Smith was in the Bahamas. "We said in October that we were willing to send someone down to her front door (to take the tests),’’ Ms Opri said. Schnider last month ruled that Smith must take part in paternity testing without specifying a deadline.

A Los Angeles judge has ordered a paternity test to determine the father of Anna Nicole Smith’s 3-month-old daughter Dannielynn Hope, PEOPLE has learned. The ruling, which was revealed on Thursday, came in a lawsuit filed by freelance photographer Larry Birkhead, who claims that he – and not Smith’s fiancé Howard K. Stern – is the father of the infant. "If I was on anybody’s Christmas list, they can scratch me off because this is the best Christmas present I could have ever received," Birkhead told PEOPLE. "I’m one step closer to beginning a relationship with my daughter." Smith’s lawyer, Ron Rale, declined to comment on the details of the ruling, but claimed the judge "threw out 80 percent of their case. "This isn’t nearly the end of the story," said Rale. Smith, 39, has been residing with Stern, 38, in the Bahamas, where she gave birth to Dannielynn on Sept. 7. Three days later, her 20-year-old son Daniel died in Smith’s hospital room. The former Playboy pinup and Stern returned to the U.S. last week for a hearing in San Francisco in her effort to collect an inheritance from her late husband, oilman J. Howard Marshall II. It’s not known whether the baby was with them. Smith and Stern, who is Smith’s longtime lawyer, exchanged vows in a Sept. 28 commitment ceremony. Stern has claimed to be the girl’s father, which he revealed that month on Larry King Live. Smith’s ex-flame Birkhead, 33, countered by filing suit demanding that Smith and the child return to the United States to submit to genetic testing. According to sources, Superior Court Judge Robert A. Schnider ruled that the parties in the case will have to work out whether the tests will be done in the United States or in the Bahamas. The whereabouts of Smith and Stern are unclear.

Entertainment Tonight is reporting that ANNA NICOLE SMITH went to the Ninth Circuit Federal Courthouse in San Francisco to mediate with a federal judge and the family of her late billionaire husband, J. HOWARD MARSHALL II, over her share of the vast fortune he left behind. The amount is estimated to be in the hundreds of millions of dollars. This is the first time she has left her home in the Bahamas for the States since the death of her son DANIEL and the birth of her daughter, DANNIELYNN. Wearing a black suit and dark sunglasses to the proceeding, Anna Nicole was accompanied by her attorney, HOWARD K. STERN, and she arrived by cab just before 10 a.m. PST. Marshall, who was six decades Anna Nicole’s senior, died in 1995 and did not include her in his will. She contends that her late husband intended to provide for her through a gift in the form of a special trust. The case has battled back and forth for years. Last February, Anna Nicole appeared before the U.S. Supreme Court, which determined that she had the right to pursue her case. Anna Nicole told ET in an exclusive interview in her Bahamian home last month that her late husband seems to be watching over her, saying, "Howard [K. Stern] is the sweetest, nicest person I’ve ever met in my life besides my husband, J. Howard Marshall II. It’s like my husband sent him to me." After Marshall’s death, she told ET, "I speak to him daily. It’s spiritual thing, you know, I talk to God, I talk to my husband. They talk to each other and they keep me straight."
